This website and online store are operated by I&P Group International Limited under the Melokiss brand.

In these Terms of Service:

• “Melokiss”, “we”, “us” and “our” refer to I&P Group International Limited;
• “Site” refers to www.melokiss.com;
• “Services” refers to the Site, online store, products, customer account features, customer support and related services provided through the Site; and
• “you” and “your” refer to the person accessing the Site, placing an order or otherwise using the Services.

These Terms of Service apply to your access to and use of the Services and to purchases made through the Site.

By using the Site or placing an order, you agree to these Terms of Service together with the policies referenced in them, including our Privacy Policy, Shipping Policy and Refund Policy.

If you do not agree to these Terms of Service, you should not use the Services or place an order.

3. ELIGIBILITY AND USE OF THE SITE

You must have the legal capacity to enter into a binding contract in your country or region to place an order through the Site.

Where a person under the applicable age of majority uses the Site, such use must be authorized and supervised by a parent or legal guardian.

You may use the Site only for lawful personal and non-commercial purposes.

You must not:

• use the Site or our products for an unlawful or unauthorized purpose;
• provide false, misleading or fraudulent information;
• interfere with the operation or security of the Site;
• introduce viruses, malicious code or harmful technology;

4. PRODUCTS AND PRODUCT INFORMATION

Melokiss offers compact products for home training, Pilates, yoga, mobility, recovery and workout organization.

Product pages are intended to provide the information reasonably necessary to understand the relevant product, including its intended use, main features, available options and included items.

Product dimensions, materials, colours, specifications, packaging and included accessories may vary slightly where this is reasonably necessary and does not materially reduce the product’s function or value.

We make reasonable efforts to present product images and colours accurately. The appearance of a colour may vary depending on screen settings, lighting and device display.

Only the items specifically listed as included on the relevant product page form part of the purchase. Background props, exercise mats, clothing, furniture, phones, bottles or other accessories shown in lifestyle images are not included unless expressly stated.

Product availability is subject to stock and delivery limitations. We do not guarantee that every product or option will remain available indefinitely.


5. PRODUCT USE AND SAFETY

Our products are intended for general fitness, movement, stretching, mobility, recovery or organizational use, as described on the relevant product page.

You are responsible for:

• reviewing the product description before purchase;
• following all included instructions and warnings;
• inspecting the product before each use;
• using the product on a suitable and stable surface;
• using the product only for its intended purpose;
• selecting movements appropriate to your ability and experience; and
• stopping use if the product is damaged or appears unsafe.

Exercise and movement involve physical effort and may not be suitable for every person.

If you are pregnant, recovering from injury, receiving medical treatment, have a health condition or are uncertain whether an exercise is suitable for you, seek advice from an appropriately qualified healthcare professional before use.

Our products and Site content are not medical devices, medical treatment or a substitute for professional medical advice unless expressly and lawfully stated otherwise.

We do not promise that use of a product will diagnose, prevent, treat or cure a medical condition. Individual experience and results may vary.


6. PRICES, CURRENCY AND TAXES

Product prices are shown in the currency displayed on the Site.

The applicable product price is the price displayed when you place your order, subject to correction of an obvious pricing or technical error.

Shipping charges, discounts and taxes collected by us will be displayed during checkout before you submit the order.

Depending on the delivery destination, customs authorities or other third parties may impose import duties, taxes or handling charges that are not collected by us. Where applicable, responsibility for such charges will be explained in our Shipping Policy or during checkout.

We may change prices for future orders without prior notice. A price change will not affect an order that has already been accepted, except where an obvious error has occurred and applicable law permits correction.


7. PROMOTIONS AND DISCOUNTS

Promotional codes, discounts and special offers may be subject to additional conditions displayed with the relevant promotion.

Unless expressly stated otherwise:

• promotional codes cannot be exchanged for cash;
• promotional codes cannot be combined;
• only one promotional code may be used per order;
• promotions apply only during the stated promotional period;
• promotions may apply only to selected products or destinations; and
• discounts cannot be applied retrospectively to completed orders.

Any material restrictions or minimum purchase requirements will be disclosed before the customer commits to the offer.


8. ORDERS AND CONTRACT FORMATION

When you submit an order, you are offering to purchase the selected products under these Terms of Service.

An order confirmation email confirms that we have received your order. It does not necessarily mean that the order has been accepted.

Unless applicable law requires otherwise, the purchase contract is formed when we:

• send a shipping or dispatch confirmation;
• otherwise expressly confirm acceptance; or
• begin fulfilling the order.

We may conduct reasonable payment, identity, address, security and fraud-prevention checks before accepting an order.

We may decline or cancel an order where reasonably necessary, including where:

• a product is unavailable;
• the payment cannot be authorized;
• information provided is incomplete or appears inaccurate;
• the order is identified as potentially fraudulent or unauthorized;
• the shipping address is outside an available delivery area;
• a pricing, availability or technical error has occurred;
• an order exceeds reasonable quantity limits;
• we reasonably believe the order is intended for unauthorized resale; or
• accepting the order would violate applicable law or a contractual restriction.

If we decline or cancel an order after payment has been collected, we will arrange a refund of the affected amount to the original payment method.

We will use the contact information provided during checkout to inform you of a material order issue or cancellation.


9. CUSTOMER INFORMATION

You must provide complete and accurate information when placing an order.

This includes, where applicable:

• your full name;
• email address;
• telephone number;
• billing address;
• shipping address; and
• payment information requested by the payment provider.

You are responsible for checking the delivery address before submitting the order.

If you notice an error after placing an order, contact customer support as soon as possible. We cannot guarantee that an order can be changed after it has entered fulfilment or shipping.

By submitting an order, you authorize the selected payment provider to charge the total amount displayed at checkout.

Payment may be authorized or collected before the order is dispatched.

Payments may be processed by third-party payment processors, acquiring banks, card networks or fraud-prevention providers. Those parties may apply their own terms and privacy practices.

Melokiss generally does not receive or store complete payment card numbers or card security codes. We may receive limited payment information such as the payment method, payment status, transaction identifier and the final digits of a card.

A payment may be declined, delayed or reviewed where required by a payment provider, card issuer, bank or fraud-prevention system.

Unless expressly stated on the relevant product page and during checkout, all purchases are one-time purchases.

We will not enroll you in a recurring payment or subscription arrangement without clear disclosure and your explicit agreement before purchase.


11. ORDER CANCELLATION

To request cancellation of an order, contact customer support as soon as possible.

We will make reasonable efforts to process the request, but cancellation cannot be guaranteed once an order has entered fulfilment, been packed or been dispatched.

Where an order cannot be cancelled, you may be able to return an eligible item after delivery in accordance with our Refund Policy.

Nothing in this section limits any mandatory cancellation or withdrawal right available under applicable consumer law.


12. SHIPPING AND DELIVERY

Available destinations, shipping methods, delivery estimates, charges and relevant fulfilment information are described in our Shipping Policy and, where applicable, during checkout.

Delivery dates and timeframes are estimates unless expressly stated to be guaranteed.

Delivery may be affected by circumstances outside our reasonable control, including:

• carrier delays;
• customs processing;
• public holidays;
• severe weather;
• incorrect delivery information;
• local service interruptions; or
• import inspections.

Tracking information will be provided where tracking is available.

You are responsible for monitoring available tracking information and contacting us promptly if an order appears materially delayed, is marked as delivered but has not been received or arrives damaged.

Risk in the products transfers as determined by applicable law. Nothing in these Terms transfers risk to a consumer earlier than permitted by mandatory consumer protection law.


13. RETURNS AND REFUNDS

Eligible unused products may be returned within 30 days of delivery, subject to the conditions, exclusions and process described in our Refund Policy.

Before returning an item, you must contact customer support and follow the return instructions provided.

Products must not be sent to the registered business address unless customer support has expressly identified that address as the applicable return location.

The registered office of I&P Group International Limited is not automatically the designated returns facility.

Return eligibility may depend on matters including:

• the date of delivery;
• the product’s condition;
• signs of use, damage or contamination;
• the presence of original components and accessories;
• hygiene or safety restrictions;
• whether the item is personalized or final sale; and
• whether the customer followed the return process.

Approved refunds are issued to the original payment method unless applicable law requires or permits another method.

The time required for a refund to appear may depend on the payment provider, card network and customer’s bank.

If a product arrives damaged, defective, incomplete or materially different from what was ordered, contact customer support promptly with:

• the order number;
• the email address used during checkout;
• a description of the issue; and
• clear photographs where reasonably requested.

Our Refund Policy does not limit any non-excludable rights relating to defective or misdescribed goods.

• does not contain confidential or sensitive information;
• does not contain malicious code or misleading promotional material; and
• complies with applicable law.

You retain ownership of content that you create.

By submitting content for publication, you grant Melokiss a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, translate and display that content in connection with the Site, our products, customer communications and Melokiss marketing.

We may moderate, refuse or remove content that violates these Terms, applicable law or reasonable review guidelines.

We do not require a review to be positive and will not knowingly present fabricated reviews as genuine customer reviews.

Where a review was incentivized, imported, collected through a third party or otherwise requires disclosure, we may add an appropriate label.


16. INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and its content are owned by or licensed to I&P Group International Limited.

This includes:

• text;
• graphics;
• layouts;
• branding;
• logos;
• product images;
• videos;
• designs;
• icons; and
• software-related content.

You may access and use the Site for personal, non-commercial shopping purposes.

By using the Services, you acknowledge that personal information may be processed by Melokiss and relevant service providers for purposes including:

• processing orders;
• arranging payment;
• preventing fraud;
• fulfilling deliveries;

• processing returns and refunds; and

Marketing and non-essential tracking activities are subject to the choices and consents required by applicable law.


19. SITE AVAILABILITY AND ERRORS

To the fullest extent permitted by law, we do not guarantee that:

• every technical error will be corrected immediately;
• every product will be suitable for a purpose that was not disclosed to us; or
• individual fitness, mobility or training results will be identical for every user.


21. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for:

• fraud or fraudulent misrepresentation;
• death or personal injury caused by negligence where such liability cannot lawfully be excluded;
• wilful misconduct or gross negligence where applicable;
• breach of mandatory consumer rights; or
• any other liability that cannot be excluded under applicable law.

Subject to the above and to the fullest extent permitted by law, Melokiss will not be liable for indirect or consequential losses that were not reasonably foreseeable when the contract was formed.

For customers purchasing products for personal consumer use, this section does not exclude liability for losses that are a foreseeable result of our breach of contract or failure to exercise reasonable care.

We are not responsible for loss caused by:

• misuse of a product;
• failure to follow instructions or warnings;
• unauthorized modification of a product;
• continued use of a damaged product;
• inaccurate information supplied by the customer;
• use outside the product’s intended purpose; or
• circumstances outside our reasonable control,

except to the extent that we are legally responsible for the relevant loss.


22. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, transport disruption, customs delays, government action, labour disruption, telecommunications failure, cyber incidents or interruption of supplier or carrier services.

Where such an event affects an accepted order, we will take reasonable steps to reduce the effect and communicate material delays where practicable.

This section does not limit any mandatory right to cancel or receive a refund.


23. CHANGES TO THE SERVICES OR THESE TERMS

We may update the Site, Services, product range and these Terms from time to time.

Changes to these Terms may be made to reflect:

• changes to our Services;
• operational requirements;
• changes in law;
• new payment or delivery methods;
• security requirements; or
• clarification of existing terms.

The revised Terms will be published on the Site with an updated revision date.

Changes will not retrospectively reduce rights arising from an order accepted before the revised Terms took effect, unless required by law.

The remaining provisions will continue in effect.


26. NO WAIVER

If we do not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.

A waiver is effective only where it is expressly confirmed in writing.


27. ENTIRE AGREEMENT

These Terms, together with the policies and information expressly incorporated into them, form the agreement between you and Melokiss concerning use of the Services and purchases through the Site.

If there is a conflict between these Terms and a product-specific term expressly displayed during checkout, the more specific checkout term will apply to that purchase, subject to applicable law.


28. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Hong Kong Special Administrative Region.

However, if you are a consumer living in another country or region, this choice of law does not deprive you of any mandatory consumer protection available under the law of your habitual residence.

Before starting formal proceedings, customers are encouraged to contact customer support so that we can review and attempt to resolve the issue directly.

Subject to any mandatory consumer right to bring proceedings elsewhere, the courts of Hong Kong have non-exclusive jurisdiction over disputes arising from these Terms or the Services.
